I trust that most of you will agree that Citizens United is the worst Supreme Court Amendment since Dred Scott.  Several bills are circulating in Congress to mitigate the damage done by this unconstitutional decision, but even if they pass, there is nothing to stop the five Republican Injustices from overturning them.  Long term, we need a Constitutional amendment to undo the damage.  Yesterday, Senator Bernie Sanders (I-VT) introduced that amendment.

Bernie Sanders (I-Vt.) today proposed a constitutional amendment to overturn a Supreme Court ruling that allowed unrestricted and secret campaign spending by corporations on U.S. elections. The first constitutional amendment ever proposed by Sanders during his two decades in Congress would reverse the narrow 5-to-4 ruling in Citizens United vs. the Federal Elections Commission. In that controversial decision almost two years ago, justices gave corporations the same First Amendment free-speech rights as people.

“There comes a time when an issue is so important that the only way to address it is by a constitutional amendment,” Sanders said of the effort to override the court decision that he labeled “a complete undermining of democracy.” 

Sanders’ Saving American Democracy Amendment would make clear that corporations are not entitled to the same constitutional rights as people and that corporations may be regulated by Congress and state legislatures. It also would preserve the First Amendment guarantee of freedom of the press. It would incorporate a century-old ban on corporate campaign donations to candidates, and establish broad authority for Congress and states to regulate spending in elections… [emphasis added]

This morning Senate Republicans blocked the nomination od Richard Cordray, as predicted yesterday.  This morning Barack Obama held a news conference and denigrated them so extensively that even Cenk Uygur approved.  Here is a description and complete video of the news conference.

9GOPNOsPresident Obama lashed out at Congress on Thursday for blocking his nomination to head a consumer financial watchdog agency, saying Americans are frustrated with legislators for holding up critical appointments to win concessions on other matters.

Speaking shortly after the Senate rejected his appointment of former Ohio attorney General Richard Cordray as head of the Consumer Financial Protection Bureau, Obama said his Capitol Hill adversaries were not acting “on the level” in their consideration of the public interest. And he complained that Republicans in Congress were systematically delaying his political appointments.

“This makes no sense,” Obama said during a short news conference in the White House briefing room. “Consumers across the country understand part of the reason we got into the financial mess we did is because regulators are not doing their jobs. … There is no reason why Mr. Cordray should not be nominated or confirmed by the Senate and should not be doing this job.”

Obama added that he would press forward with trying to install Cordray, including a potential recess appointment during the holiday break, a move that Congress could not block if it were not in session.

“We are not giving up on this; we’ll keep on going at it,” Obama said. “We will not allow politics as usual on Capitol Hill to stand in the way of American consumers being protected from unscrupulous operators.”

He added that Congress has been systematically holding up many of his other appointments…

I have mixed feelings about Sebelius’ decision on the morning after pill, but otherwise, Obama was spot on.

From San Francisco Chronicle: Newt Gingrich’s network of businesses and policy groups that laid the groundwork for his presidential bid harken back to those that got him into ethics trouble and led to the biggest monetary penalty imposed on a U.S. House speaker.

The charges raised more than a decade ago revolved around allegations that the former speaker improperly used tax-exempt charitable and education organizations to advance partisan political purposes. Today, government ethics advocates say the former speaker used a tax-exempt public policy group to promote his candidacy.

Could it be more clear that Newt’s ethics have not changed a bit since he was drummed out of the House in disgrace?

From Alternet: On Wednesday night, Republican presidential front-runner Newt Gingrich held a fundraiser at the posh Willard InterContinental hotel in downtown Washington, DC. Waiting there for Gingrich were a few dozen protesters. Around 7 p.m., they snuck through an unlocked back door to the candlelit ballroom hosting the Gingrich affair and caused a ruckus.

There has been much confusion about whether extending the payroll tax cut will direct funds away from the Social Security and Medicare trust funds.  Saying that it will has become a standard Republican talking point as an excuse for opposing it, and the confusion has spread to our side of the aisle as well, since most Representatives and Senators have not actually read the bill.  It’s time for the confusion to end.  Extending the payroll tax cut will NOT undermine Social Security.

8social-security-checkAs some Republicans, including Majority Leader Eric Cantor (VA), are growing worried that opposing a payroll tax cut extension will undercut their message as anti-tax zealots, other Republicans have opposed the extension at every turn. Despite their staunch opposition to raising taxes on millionaires, these Republicans have cycled through the reasons to avoid providing a tax cut to the middle class that would allow the average family to pocket an extra $1,000 a year.

The latest argument to emerge from the GOP has been that extending the payroll tax cut would undermine Social Security, since payroll tax revenue goes directly into the Social Security Trust Fund. Multiple Congressional Republicans have adopted that theory of late, including South Carolina Sen. Jim DeMint (R), who put it to use on CNBC last night…

That argument, which has been adopted by members of both parties and perpetuated by news outlets like NPR, has one problem: it’s not true. Each of the plans under consideration is fully paid for, replacing revenue the Social Security Trust Fund would have lost from lower payroll tax receipts with money made up from either alternative revenue sources or spending cuts. The earlier payroll tax holiday, set to expire this month, was also fully-funded, and the program has thus far “been held harmless” from the holiday, as Reuters noted today… [emphasis added]

The Director of the Social Security Administration has confirmed that this is true.  Neither the proposals under consideration, nor the current payroll tax relief have or will diminish the Social Security and Medicare trust funds by a single penny.  Republicans oppose it for another reason.  Every penny that goes to help Main Street Americans is a penny Republicans can’t give to a billionaire.

When Elizabeth Warren withdrew her name from consideration for Director of the Consumer Financial Protection Board (CFPB), due to the certainty of Republican obstruction, she recommended Richard Cordray, and Obama followed her good advice.  Now Republicans have vowed to block Cordray as well.  The reason is that Republicans do not want consumers protected from abuse by Big Finance.  They side with the predators, and they are doing all they can to preserve the status quo that caused the Republican Recession, but enriched the 1%.

8CordraySenate Republicans on Wednesday showed no signs of backing down from their threatened filibuster of President Barack Obama’s nominee to head a new financial watchdog agency, even as Democrats framed the fight as a stark choice between Wall Street and Main Street.

“Wall Street has a legion of lobbyists protecting its interests. We need someone who can protect Main Street’s interest,” said New Jersey Sen. Bob Menendez, who joined other Democratic members of the Senate Banking Committee at a news conference. “And that’s what Richard Cordray would be as the director of the Consumer Financial Protection Bureau.

Cordray’s nomination is destined to fail in the Senate on Thursday, with Republicans nearly united in their opposition to the former Democratic Ohio attorney general. Massachusetts Sen. Scott Brown is the only Republican who’s publicly backed the nomination, saying Cordray should be confirmed with a simple majority, not the 60-vote threshold the GOP has insisted on to avert a filibuster.

Republicans’ message to Cordray: Don’t take it personal. They just don’t want anyone heading the agency until its powers are rolled back… [emphasis added]

From The Guardian: Rod Blagojevich, the ousted Illinois governor whose three-year battle against criminal charges became a national spectacle, was sentenced to 14 years in prison Wednesday, one of the stiffest penalties imposed for corruption in a state with a history of crooked politics.

Blagojevich’s 18 convictions included allegations of trying to leverage his power to appoint someone to President Barack Obama’s vacated Senate seat to raise campaign cash or land a high-paying job.

The twice-elected Democrat is now the second former Illinois governor in a row to be sentenced to prison, and the fourth Illinois governor in the last four decades. His Republican predecessor, George Ryan, currently is serving a sentence of 6 1/2 years, also for corruption.

What is it about Illinois?

From NY Times: Prosecutors in Philadelphia announced Wednesday that they had dropped their attempts to execute Mumia Abu-Jamal, the death row inmate convicted of killing a police officer 30 years ago and whose subsequent legal case based on claims of innocence had received international attention.

Mr. Abu-Jamal will spend the rest of his life in prison without the possibility of parole, said Seth Williams, the district attorney for Philadelphia.

I haven’t investigated this in many years and have forgotten many of the details, but remember that, the last time I did, I thought the case against him was not clear cut and has the appearance of a frame up, especially since witnesses have recanted, and other witnesses have said they did not testify on his behalf, because police had threatened them.  In any event, I’m glad he’s off death row.

A hundred years ago, Teddy Roosevelt gave a speech at Osawatomie Kansas that laid the foundation for the progressive movement.  Here is the text of TR’s speech.  It’s worth the read.  Today, Barack Obama followed in TR’s footsteps with the finest oratory I have seen from him, as he identified and supported the progressive values of the 99% movement.  I have been unable to find the complete video, but I do have a link to the text of the speech and four videos from some of my favorite commentators.

Yesterday drained me pretty well.  I had to run errands and, in the process, walk about a mile and a half.  My COPD, already exacerbated from an upper respiratory infection, flared up severely.  Other than this Open Thread, I have only one article, but it’s a biggie.  I’m current, albeit brief, with replies.  Today I will be recovering from yesterday.

From CBS: President Obama and Secretary of State Hillary Clinton announced Monday that the United States will now use foreign aid as a tool to improve Lesbian, Gay, Bisexual and Transgender rights abroad.

I applaud this move.  Hopefully it will do some good, including defusing C-Street Republican support for Uganda’s bill to execute gays.

From ABC: Senate Republicans rejected a new, tweaked Senate Democratic payroll tax  cut extension proposal because they say it is not, as billed by Democrats, a compromise bill.

This is exactly as I called it yesterday.  It didn’t require rocket science.
