Yesterday I fell asleep in the Church of the Ellipsoid Orb.  I meditated upon Ravens and Texans, but went out, while meditating upon Giants and Packers.  Congrats to the conference finalists: the Ravens, the Patriots, the Giants and the Fortyniners.  I’m current with replies.  Today I have errands to run.

It did not take long for there to be  a legal challenge to Barack Obama’s recess appointments.  As I anticipated, the challenge comes from a business front group, rather than from the Republican Party, as Republicans have no standing to sue over them.  The manner in which the challenge has developed could nor demonstrate more clearly why the appointments were so necessary.

15NLRBPresident Barack Obama’s recess appointment of three members to the National Labor Relations Board was challenged in court by the National Federation of Independent Business, which claims a constitutional violation.

The filing yesterday may be the first legal action targeting the White House appointments made without Senate confirmation on Jan. 4 during a brief congressional break. It was made as part of an existing lawsuit in federal court in Washington over a new NLRB rule that requires employers to notify workers of their rights to form a union.

Without a legal quorum, the board has no authority to enforce the rule, the NFIB, which was joined by four other groups and companies in the filing, argued.

“The grounds for the motion are that very significant events have transpired since the filing of the complaints in this case, particularly within the last ten days,” according to the filing. “The president purported to appoint the new members without the advice and consent of the Senate.”… [emphasis added]

Here it is in a nutshell.  The NLRB needs a quorum to enforce its rules, such as the rule that requires employers to notify employees on their right to form a union.  Anti-union employers want to disobey those rules, thus depriving workers of their just rights.  To enable such employers to get away with breaking the law, Senate Republicans hobbled the NLRB by refusing to confirm anyone appointed to the boards, thus preventing an NLRB quorum.  Obama’s recess appointments to fill the vacancies on the NLRB created the quorum necessary for the NLRB to enforce the law.

Any vote that does not help keep Republicans out of office is a vote against workers rights.

Few things could be more tragic to human rights in this nation than passage of the Stop Online Piracy Act (SOPA),  introduced by Rep. Lamar Smith (R-TX) and/or the Protect IP Act (PIPA), introduced by several Senators from both parties.  Intended originally to protect property rights to copyrighted material, they went way overboard making it impossible for content providers to protect themselves from being shut down for the smallest unintentional violation.  Fortunately the Obama Administration has rejected SOPA and PIPA.

15SOPAOpponents of online piracy regulation bills SOPA and PIPA scored a major victory on Saturday.

The White House has officially responded to two online petitions, "Stop the E-PARASITE Act" and "Veto the SOPA bill and any other future bills that threaten to diminish the free flow of information," which urged the President to reject SOPA and PIPA.

The authors of the statement, Victoria Espinel, Intellectual Property Enforcement Coordinator at Office of Management and Budget, Aneesh Chopra, U.S. Chief Technology Officer, and Howard Schmidt, Special Assistant to the President and Cybersecurity Coordinator for National Security Staff, said that the White House will not support legislation that disrupts the open standards of the Internet.

"While we believe that online piracy by foreign websites is a serious problem that requires a serious legislative response, we will not support legislation that reduces freedom of expression, increases cybersecurity risk, or undermines the dynamic, innovative global Internet," the statement read in part.

House of Representatives bill SOPA and its Senate counterpart PIPA are designed to target copyright violations by foreign-based websites that make available, for example, free movies and music without the permission of the U.S. rights holders…

While the Neocon, Corporacon and Plutocon wings of the Republican Party appear to be coalescing around vulture capitalist, Mitt Romney, the Republican Theocon and InsaniTEA wings are appalled at the possibility that someone they consider a heretic might get the Republican nomination.  They correctly recognized that splitting their support between three followers of Republican Supply-side Jesus (not the real one) was helping Romney, so they met this weekend to choose their unified anti-Romney savior.

The move represents an eleventh-hour effort by social conservatives one week out from the crucial South Carolina primary to unify around a single candidate and blunt the momentum of former Massachusetts governor Mitt Romney, whom many evangelicals consider insufficiently conservative.

But in a sign that the effort may be too little too late, the leaders did not discuss any plans to urge former House speaker Newt Gingrich or Texas Gov. Rick Perry to drop out of the White House race, according to one participant — meaning that social conservatives could well split their support this year, just as they did during the 2008 GOP presidential primary.

“That was not even a part of the discussion,” Family Research Council President Tony Perkins told reporters Saturday afternoon when asked whether participants discussed any effort to push Gingrich or Perry from the GOP contest…

They picked the worst hatemonger in the bunch.  Rick “Google Me” Santorum hates gays, black people, and women.  He may also hate dogs, being so fixated on man on dog sex. 😉

Frankly, I think Republican Supply-side Jesus (not the real one) may well have misled these folks, because they have obviously slipped in the Santorum.

Yesterday I started working early to get my research done and as much written as possible in the morning, to free me for deep spiritual meditation on the holy Ellipsoid Orb for the rest of the day, with emphasis on the Denver/New England meeting in the evening.    The game was disappointing, because the Patriots outclassed the Bronco in every area.  They clearly deserved to win.  I can’t complain.  The Broncos made it to the conference semi-finals in what they always intended to be a rebuilding year with a brand new head coach and a brand new rookie Quarterback.  They outperformed expectations.  I’m current with replies.  WE are getting our first sow showers of the winter.  Tomorrow is another high holy day in the Church of the Ellipsoid Orb.

From Crooks and Liars: An ongoing John Doe investigation into possible illegal activity by aides to Wisconsin Gov. Scott Walker (R) expanded when Walker’s spokesperson, Cullen Werwie, was given prosecutorial immunity. Speculation as to the reasons for the immunity, which authorities haven’t revealed, don’t signal good news for Walker.

Werwie was Walker’s travelling press aide, giving him close access to Walkers day to day activities and communications.  It does not look good for Fartfuhrer Walker.

From USA Today: Geothermal energy developers plan to pump 24 million gallons of water into the side of a dormant volcano in Central Oregon this summer to demonstrate new technology they hope will give a boost to a green energy sector that has yet to live up to its promise.

They hope the water comes back to the surface fast enough and hot enough to create cheap, clean electricity that isn’t dependent on sunny skies or stiff breezes — without shaking the earth and rattling the nerves of nearby residents.

Once again, Oregon leads the way in environmentally sane practices.

From Common Dreams: Europe has been plunged into a fresh crisis after France was stripped of its coveted AAA credit rating in a mass downgrade of nine eurozone countries by the ratings agency Standard & Poor’s.

S&P said austerity was driving Europe even deeper into financial crisis as it also cut Austria’s triple-A rating, and relegated Portugal and Cyprus to junk status.

Now that Europe has demonstrated the failure of austerity, Republicans will be all the more anxious to institute it here.

Yesterday Barack Obama proposed that Congress give him the authority to merge six separate agencies related to commerce, in  move sure to confound Republicans.  Although nobody will be fired, this will eliminate 1,000 federal jobs by attrition, save $3 billion, eliminate duplication of effort, and provide one-stop access for business.  In theory, this should be a Republican wet dream, except for one thing.  They hate Barack Obama more than they like their own policies.

14ObamaPresident Obama will ask Congress on Friday for the power to consolidate parts of the federal government, proposing a first step of combining several trade- and commerce-related agencies under a plan that the White House said could eliminate more than 1,000 jobs and save $3 billion over 10 years.

A senior administration official said the White House proposal is Obama’s follow-through on his promise during last year’s State of the Union address to create a leaner, more efficient bureaucracy.

But the move also comes at a politically opportune moment, as the president heads into his re-election campaign and aims to blunt Republican criticism that his policies have stunted business growth and bloated the federal budget at a time of ballooning debt…

Congressional Republicans scoffed at the relatively small scale of Obama’s proposal, saying many more cutbacks are needed to tame the deficit.

…Obama will propose combining the functions and staff of six trade- and commerce-related agencies and offices: the Small Business Administration; the Office of the U.S. Trade Representative; the Export-Import Bank; the Overseas Private Investment Corporation; and the Trade and Development Agency. The move would ease the regulatory burden on businesses and save money by eliminating duplicative functions such as human resources, the White House official said… [emphasis added]

My best estimate is that, since this is good for America, Republicans will hold it hostage and attempt to negotiate something bad for America, such as piling more hardship on the poor,  in return.

Loving others is a principal tenant of Christianity, but far to many people many people fail to realize that authentic Christianity and Republican Supply-side pseudo-Christianity are completely unrelated.  Here is an example of Republican Supply-side pseudo-Christianity in action.

14GOPjesusThinkProgress reported last week that Kansas House Speaker Mike O’Neal (R) was forced to apologize to First Lady Michelle Obama after forwarding an email to fellow lawmakers that called her “Mrs. YoMama” and compared her to the Grinch.

Earlier that same week, the Lawrence Journal-World was sent another email that O’Neal had forwarded to House Republicans that referred to President Obama and a Bible verse that says “Let his days be few” and calls for his children to be without a father and his wife to be widowed.

Nick Sementelli at Faith in Public Life notes that Psalm 109, which is a prayer for the death of a leader, became a popular conservative meme after Obama’s election. The “tongue-in-cheek” prayer for the president was seen on bumper stickers. The relevant part of the psalm reads:

Let his days be few; and let another take his office

May his children be fatherless and his wife a widow.

May his children be wandering beggars; may they be driven from their ruined homes.

May a creditor seize all he has; may strangers plunder the fruits of his labor.

May no one extend kindness to him or take pity on his fatherless children.

O’Neal forwarded the prayer with his own message: “At last — I can honestly voice a Biblical prayer for our president!… [emphasis original]

I have often been accused of hating Republicans, but revealing the facts about their avowed beliefs, policies and actions is accuracy, not hatred.  Furthermore, the most harm I have ever wished on any Republican is unemployment from public office, and/or prosecution for crimes with all the rights and protections the law allows.

Ron Paul’s Big Brother State

Ron Paul is making it a point to repeat that Americans need liberty, free from interference from the big Nanny State.  That may be reasonable, except for one thing.  Ron Paul is lying, because he has no qualms about having the Big Brother state take the liberty from and trampling the rights of individual Americans.

14paul-abortionWhen GOP presidential hopeful Ron Paul was asked today about Tuesday’s federal court ruling upholding an aggressive new sonogram law in his home state of Texas, the congressman said the requirement that women seeking an abortion first get a sonogram “should always have been a Texas state position.’’

“Like Roe v Wade should never have been heard in the Supreme Court,” he said after a midday speech and rally at the Columbia Metropolitan Airport at the Eagle Aviation Building .

Paul, who opposes abortion rights, has consistently railed against intrusive Big Brother government when it comes to other issues, especially health care reform. But it’s hard to imagine anything more literally invasive than a required sonogram.

In fact, Dr. Paul’s colleagues in the Texas Medical Association came out against the law last year, saying it “not only sets a dangerous precedent of legislation prescribing the details of the practice of medicine, but it also clearly mandates that physicians practice in a manner inconsistent with medical ethics.”… [emphasis added]

It should come as no surprise to anyone that Ron Paul has lied about liberty.  After all, he is a Republican.  Furthermore, he is the same Republican bigot who wrote racist articles, defended their content three years after writing them, and recently said he never knew about them until ten years after writing them.  He is not fit to hold public office.
