Barr or Not?

William Barr will almost surely be confirmed by the Senate as our next Attorney General.  I have severe reservations about him, but the best Democrats can hope to accomplish is to delay his nomination through procedural means.  Is it worth the effort to do so, or should we hold our limited political capital in the Senate for more critical matters?  Here are concerns from his hearing.

0116Barr

President Donald Trump’s efforts to exert control over the Justice Department — one of the few bodies left that can assert a real check on his power and corruption — have been an ongoing crisis and scandal during his time in office. In that context, his nomination of former Attorney General William Barr to retake the top position at the head of the department warrants extreme scrutiny.

And given the fact that Barr crafted a 20-page memo over the summer purporting to argue that Special Counsel Robert Mueller’s theory of how the president obstructed justice — a theory Barr can’t, in fact, have had any reliable information about — looks so dubious. He passed the memo along to both Justice Department officials and Trump’s legal team, a move that appears suspiciously like an application for the attorney general position on the basis that he would counter Mueller’s and others’ potential attempts to expose the president’s wrongdoing.

But his history as attorney general on President George H.W. Bush and his standing as a respected conservative legal mind give him credibility among Senate Republicans, all but assuring that his nomination will be successful.

Given the likelihood that he will be approved, here are 10 disturbing moments from his testimony on Tuesday:

1. Barr doesn’t pledge to follow the ethics officials’ advice on recusing himself from investigations.

In perhaps the biggest takeaway of the day, Barr confirmed an answer he had already given to the Senate in writing: While he will consult with ethics officials about whether to recuse from investigations, including those involving the president, he did not pledge to follow their guidance.

“Under the regulations, I make the decision,” he said.

This is particularly disturbing because Acting Attorney General Matthew Whitaker, who clearly appeared to be appointed in an effort for the president to gain control over the Mueller probe, reportedly refused an ethics official’s recommendation to recuse from it.

2. He did not commit to making Mueller’s report public.

Barr’s comments on the so-called “Mueller report” were somewhat complicated because, as he correctly pointed out, Mueller is not directed to release a report under the special counsel’s guidelines. Instead, Mueller will submit a report to the attorney general, and the attorney general may or may not then decide to release a public version of a report. Barr said he would try to get out as much information as is possible under the regulations.

But when Sen. Amy Klobuchar (D-MN) asked specifically if he would “commit to make public all of the Mueller report’s conclusions, even if some of the evidence supporting the conclusions can’t be made public?” Barr only hedged, saying “That’s certainly my goal and intent.”

3. He said he didn’t know what the Constitution’s Emoluments Clause says.

One of the enduring violations of the Trump presidency has been his flouting of the Constitution’s Emoluments clause, which forbids public officers from taking forms of payment from foreign governments. Lawsuits are currently progressing against the president and the administration in this matter, but when pressed about the issue, Barr implausibly expressed ignorance.

“I think there’s a dispute about what the Emoluments Clause relates to,” Barr said. “I had not personally researched the emoluments clause. I can’t even tell you what it says at this point.”… [emphasis original]

I shared only the first three concerns in Barr’s testimony.  Click through for the other seven.

The following video is an excerpt from Barr’s questioning by Sen. Patrick Leahy [D-VT].

Like so many Republicans, he slithers well.

So what do we do?  I’d say it’s best not to fight his confirmation for the following reasons.  If we try, we will fail.  It’s best to avoid the enmity from Barr toward Senate Democrats that opposition would encourage.  Until a new AG is confirmed, Acting AG Matthew Whitaker, a goose-stepping Trump sycophant, is a major threat to the Russia investigation.  We won’t get a better nominee from Trump.

For now, it’s best to keep our powder dry.

Yesterday the computer tech did a great job.  He cleaned up the horrible bird’s nest of wires behind my computer that I cannot reach.  He got my screen working on the original DIV cable, and used the HDMI output on the video card to send computer images to my TV.  He scanner on my laser printer configured so that it works with the laser printers control center software. And he set my notebook computer up on the network, and installed a utility that allows me to control my home computer from a remote location over a secure encrypted connection.  I’m very pleased with him.  Portlanders, he’s Peter from Bolt Computers.  Store to door is delivering a grocery order today and I’ll need to unpack and stow them.  Later, WWWendy is coming to destink the vile TomCat and help with cores.  In short, it’s a busy day here at the CatBox.

From NY Times: After suffering the worst parliamentary defeat in modern times over her plans for leaving the European Union, Britain’s prime minister, Theresa May, endured another day of turmoil on Wednesday, when she is to face a vote of no confidence in her battered government.

On Tuesday Mrs. May lost by a crushing margin, 432 to 202, when Parliament voted on her plan for European Union withdrawal, or Brexit, as the clock ticks toward March 29 when Britain is scheduled to leave.

Lawmakers spent much of Wednesday debating whether Mrs. May’s government should continue in power before voting at around 7 p.m. on a motion that could, in theory, lead to a general election.

That is an unlikely outcome, analysts say, because many of those who voted against Mrs. May’s withdrawal plan, including hard-line pro-Brexit rebels in her Conservative Party, and a group of 10 lawmakers from Northern Ireland’s Democratic Unionist Party, have said they will support the government on Wednesday.

We should remember that British Republicans, aka Tories, were suckers for Russian propaganda (Brexit) before US Republicans. I’d love to see Labour kick their Bridiot butts! RESIST!!

I was going to have a bowl of beef barley soup last night for dinner.  I had left it on the counter ready to go in the microwave.  When I went down to the kitchen to feed my cats, I saw that the container was open and the soup gone!  The guilty party was my Winnie and needless to say, he was not so hungry at dinner time.  I am sure that the other two helped, but Winnie is the one who opens lots of things including the treats jar at the vet’s.  Well I had to settle for beans instead.  I am off to physio tomorrow morning so I am posting this very early.

AlterNet — On Tuesday morning, in a huge victory for civil rights activists, federal judge Jesse Furman issued an order blocking President Donald Trump’s Department of Commerce from adding a citizenship question to the 2020 Census.

The case, brought by the New York State Attorney General’s office, is almost certain to be appealed by the Justice Department in a battle that could end up in the Supreme Court: …

Hallelujah!  Another set back for the Trumpians, well at least for now.  I am certain that this decision will be appealed all the way to the Supreme Court, but for now, let’s enjoy.

Vox — UK Prime Minister Theresa May spent months negotiating a deal with the European Union on the terms of Brexit, Britain’s exit from the EU.

On Tuesday, the UK Parliament voted to reject the deal by a resounding 432-202 margin — the largest legislative defeat any prime minister has suffered in modern British history.

May’s defeat should dispel any illusion that there is a happy ending to the Brexit story. The truth of the matter is that the project that defined May’s premiership — negotiating a Brexit deal acceptable to both the EU and pro-Brexit legislators in her Conservative Party — was structurally impossible. The terms on which Conservative Brexiteers wanted to leave the EU were not acceptable to EU negotiators, and the compromises necessary to bring EU negotiators on board were not acceptable to Conservative Brexiteers. No amount of negotiating could address this dilemma.  …

Now, in the clarifying light of this vote’s failure, it’s time to be honest. Barring a dramatic and unexpected change, there are two plausible outcomes to the Brexit drama. Either the UK exits the EU without a deal by the March 29 deadline, which virtually every expert agrees would result in economic catastrophe, or else the country pulls back from the brink and decides to remain in the EU.

I hope you’ll read the entire article as it explores the effect of the Brexit decision and the collapse of this agreement.  The ramifications can have a global affect.  Back in 2016, David Cameron was Conservative Party leader and Prime Minister when he called for a referendum for leaving the European Union.  Cameron himself favoured staying in the EU, but the referendum results said otherwise with 52% of the voters supporting leaving the EU.  As a result, Cameron resigned as PM and Theresa May was elected by the Conservative Party as its leader and thus became PM.  As I recall, after the referendum, there were many people who voted for leaving the EU but later found out that their knowledge of the effects of the consequences was faulty.    Some politicians lied!  May committed to honouring the will of the people and set out to negotiate the Brexit agreement with the EU.  It was that agreement that was voted down today — 432 to 202.  Jeremy Corbyn, the opposition leader in Parliament has tabled a non confidence vote which could see the Conservatives lose their current position and an election called.  All this with little more than 60 days until Britain leaves the EU.  As aside, don’t you wish that the US had a non confidence vote system — might be able to get rid of Trump more quickly.

Daily Kos — No matter what Individual 1 says, people coming across our border with Mexico without authorization is not an emergency, or a crisis (although the Trump Administration has turned it into a humanitarian crisis). The graph on the right shows the number of people apprehended crossing the border illegally—a very reasonable proxy in terms of a trend over time for the number of people crossing in general.

Look at the numbers in fiscal year 2018 compared to 2000. Apprehensions are less than one-quarter of what they were. Trump calls that an emergency? It seems more like a success, but hey, I’ve never been a reality show host, so what do I know.

Trump has spent the last three years screaming about criminals and terrorists coming across the border. The terrorism claim is absolute bunk. Nicholas Rasmussen served from December 2014 to December 2017 as director of the National Counterterrorism Center (NCTC). His job was “to lead the government’s efforts to collect and analyze all available information about terrorist threats to the Homeland.” Here’s his take:

“There is no wave of terrorist operatives waiting to cross overland into the United States. It simply isn’t true. Anyone in authority using this argument to bolster support for building the wall or any other physical barrier along the southern border is most likely guilty of fear mongering and willfully misleading the American people.”

To say the least, Trump’s bullshit factory is working overtime producing lies about the southern border and he’s holding 800,000 US employees hostage with his temper tantrum.

Short Takes:

From The New Yorker: Most people who are innocent of any crimes will still need to hire thirty-five lawyers at some point, a new study shows.

According to the study, commissioned by the University of Minnesota Law School, thirty-five is the “bare minimum” number of lawyers that an innocent person should have on retainer in the event that he or she becomes the subject of an entirely unjustified criminal investigation.

“We found that many innocent people are going through life without taking the basic precaution of hiring thirty-five lawyers,” Professor Davis Logsdon, who supervised the study, said. “They are flirting with disaster.”

“An innocent person who has absolutely nothing to hide should do everything in his or her power to avoid answering questions from investigators,” he said. “Thirty-five lawyers can really help you do that.”

Additionally, Logsdon noted, hiring nearly three dozen lawyers is invaluable because of the powerful statement it makes. “Nothing says ‘I’m innocent’ like hiring thirty-five lawyers,” he said.

From YouTube (Parody Project Channel): THE WALL CAME A TUMBLIN’ DOWN – Parody

Thanks Don! May the whole damn Republican Reich come tumbling down. RESIST!!

From NY Times: House Republican leaders removed Representative Steve King of Iowa from the Judiciary and Agriculture Committees on Monday night as party officials scrambled to appear tough on racism and contain damage from comments Mr. King made to The New York Times questioning why white supremacy is considered offensive.

The punishment came on a day when Mr. King was denounced by an array of Republican leaders, though not President Trump. The Senate majority leader, Mitch McConnell, suggested Mr. King find “another line of work” and Senator Mitt Romney said he should quit. And the House Republicans, in an attempt to be proactive, stripped him of the committee seats in the face of multiple Democratic resolutions to censure Mr. King that are being introduced this week.

Those measures would force Republicans to take a stand on the House Democratic majority’s attempt to publicly reprimand one of their own.

Too little, too late. Steve King has been doing this for years, and all these Republicans have been gleefully goose-stepping with him all along. RESIST!!

Teachers Fight for Kids

This morning the teachers and other educators at the nations largest school district, the LA Unified School District, went on strike in an attempt to save the schools they serve from starvation by the predatory practices of the Republican Reich.  While Republicans say the teachers are motivated by greed, the district and the union are very close on that issue.  Where they are not close are class size, reductions in standardized testing, increased support staff (Most schools lack a librarian, and many don’t even have a school nurse.),  and limitations on district creating limits on new and on spending on charter schools.

Los Angeles Teachers Strike

Tens of thousands of Los Angeles teachers went on strike Monday after contentious contract negotiations failed in the nation’s second-largest school district.

“Students, we are striking for you,” teachers union President Alex Caputo-Pearl told a cheering crowd of teachers marching in pouring rain.

Members of United Teachers Los Angeles voted last year to walk off the job for the first time in three decades if a deal wasn’t reached on issues including higher wages and smaller class sizes.

Months of talks between the union with 35,000 members and the Los Angeles Unified School District ended without a deal. It follows teacher walkouts in other states that emboldened organized labor…

The issues are complex, but this video should help clear it up for you.

Several years, I worked part time as a tutor in the computer lab of a community college.  My GED kids were pretty squared away, but about a third of the kids that had graduated from public high schools were functionally illiterate.  To get them through computer science, I had to help them learn to read.  Teachers are trying to change that, so I fully support their strike to get them the tools and support they need.

From Alternet: We find it easy to dismiss the fantastical beliefs of people in other times and places, but those that we’ve been exposed to since childhood seem not so far out. Virgin birth? Water turning into wine? A fig tree shriveling on the spot? Dead people getting up out of their graves and walking around?

All of the following beliefs are found in respected religions today. They have been long taught by religions that either are considered part of the American mainstream or are home grown, made in the U.S.A., produced here and exported. Some of these beliefs are ensconced in sacred texts. Others are simply traditional. All, at one time or another, have had the sanction of the highest church authorities, and many still do.

How many of them can you match up with a familiar religious tradition? (The answers are at the bottom.)

From RWW: With Justice Ruth Bader Ginsburg missing oral arguments this week as she recovers from surgery to remove cancerous tumors from her lungs, Religious Right activists are circling the Supreme Court like vultures, gleeful at what they see as an imminent opportunity to seal a solid far-right majority on the Supreme Court and fulfill their goals to overturn Roe v. Wade, eliminate legal equality for LGBTQ people, undermine separation of church and state and roll back decades of court rulings and federal programs protecting worker safety, public health, and the environment. Trump boosters have been praying since his election that God would “remove” Supreme Court justices, who enjoy lifetime appointments, so that Trump would be able to fill the vacancies.

Earlier this week, Jerry Falwell Jr. re-tweeted right-wing activist Charlie Kirk’s tweet [anti-Christian de-linked]mentioning Ginsburg and Justice Stephen Breyer and calling it “Bad news for Democrats” that the “two oldest judges on the bench are radical liberals.” Gary Bauer noted Ginsburg’s absence at oral arguments and linked to a Daily Caller story about the White House making “quiet preparations” to fill a vacancy, which Bauer said “would be an incredible opportunity for a first-term president.”

Anti-gay activist Matt Barber tweeted [anti-Christian de-linked] last night that he was praying for Ginsburg “in her twilight time” that she would “accept Christ as her Lord & Savior & beg His forgiveness for the millions of innocent babies she’s helped to slaughter.”

Barber followed up by tweeting [anti-Christian de-linked]—with the caption “Warming up in the bullpen”—a photo of Amy Coney Barrett, a Trump-nominated federal appeals court judge who has been on his Supreme Court short list, and who has been declared God’s choice for the Supreme Court by dominionist “prophets” and Religious Right leaders.

The author calls these Republican pseudo-Christians ‘vultures’, as they pray for RBG to die so their Fuhrer can appoint Amy Coney Barrett. As an Injustice on SCROTUS (Republican Unconstitutional VD), she would be worse than Kava-Nazi. That’s unfair to the vultures. RESIST!!

It is “chaos and hate from the GOP as Democrats get to work”.  And Democrats are coming out of the block like gangbusters ready to put Republicans in their place!

From Alternet

This week, tensions in Washington continued to grow as President Donald Trump tries to leverage his government shutdown to get his border wall. Meanwhile, a number of state legislatures were sworn in, and the newly-empowered House Democrats began to open investigations into the Trump administration. And in the midst of everything, right-wing politicians and activists are still getting themselves into trouble.

Here are five of the craziest right-wing moments this week:

  1. Steve King says there’s nothing wrong with white supremacy.

Rep. Steve King (R-IA) is one of the House GOP’s most frequent humiliations. He has a long history of racist comments, has promoted content from neo-Nazis, and gave an interview to a far-right Austrian party founded by an SS officer while on a Holocaust awareness tour of Europe. But this week, he stepped so far over the line that even he seemed to realize he was in trouble.

In an interview with The New York Times this week, King actually said he didn’t see the problem with being a white supremacist. “White nationalist, white supremacist, Western civilization — how did that language become offensive? Why did I sit in classes teaching me about the merits of our history and our civilization?”

As even fellow Republicans started to condemn him, King put out a statement attacking the Times for reporting what he said. He also denied being a white nationalist, saying that he was simply a regular nationalist, and “an advocate for Western Civilization’s values” — although it is worth noting he has previously claimed he thinks the reason “Western Civilization” is so good is that is has so many white people contributing to it.

While King managed to barely survive a Democratic challenge last year in his deep-red congressional district, he may face an even harder battle the next time around. That’s because Republicans are so fed up with his antics that he is now facing a primary challenge from state Sen. Randy Feenstra.

It should be no surprise then that Rep Steve King tweeted:

Mr. President @RealDonaldTrump if the time comes that it is necessary for you declare a state of emergency for border security, build the whole wall out of concrete. Let it stand forever as a monument to the Rule of Law.

The Rule of Law???  He has to be kidding.  Unfortunately he is not.  This racist idiot knows nothing of the Rule of Law!

This is just the first of five examples of Republicans lost in the morass of their own making.  Undoubtedly there are many more but there is no room to list them all.  Click through for the other four.
