At the outset, I’d like to thank JL A, who knew I have published similar articles as the start of the Supreme Court term.  Had she not emailed me the link, I would have missed it.  The Supreme Court is evenly split.  The four Justices of SCOTUS are Ginsburg, Breyer, Sotomayor and Kagan.  The four Injustices of SCROTUS (Republican Constitutional VD) are Roberts, Scalito, Thomas and Kennedy.  I fear many cases will be deadlocked, but several will be interesting.

The Supreme Court begins a new term next week with a docket of cases that could have sweeping implications for religious freedom, jury deliberations and congressional redistricting.

Whether the court will be able to resolve all of its cases remains to be seen. The justices deadlocked several times last term, with the court evenly split between the conservative and liberal wings after the death in February of Justice Antonin Scalia…

…Here are five of the most interesting cases before the court.

1. Trinity Lutheran Church of Columbia Inc. v. Pauley

This case centers on a Missouri program that gives schools money to buy recycled tires to resurface playgrounds.

Trinity Lutheran Church of Columbia requested funding for a playground on church property that’s used by its licensed preschool and daycare, called the Learning Center.

The Missouri Department of Natural Resources denied that request, citing state constitutional policy prohibiting public funds supporting churches.

Both the district court and the 8th Circuit Court of Appeals sided with the state.

The justices are being asked whether religious schools can be denied equal access to government benefits. Trinity additionally argues the rejection is a violation of both the First Amendment’s religious freedom clause and the 14th Amendment’s promise of equal protection under the law.

Court watchers note that the court accepted this case before Scalia died.

In my opinion, religions schools should not receive government financial aid of any kind.  If people want to send their children to religious schools, that is their right, but religious organizations, especially ones representing Republican Supply-side pseudo-Christians, want everyone else (taxpayers) to pay for it.

Here are the results of our “Despicable Trump Supporters” poll.  Politics Plus Polls are not scientific, because those who respond are not balanced according to demographic categories.   Therefore, we do not accurately reflect the makeup of the US population.  Nevertheless, our polls are usually factually accurate, and more often than not, they reflect thinking or will of the national majority.

When I wrote the poll, I used synonym for deplorable, and felt that using that word might influence the poll.  I voted 60 – 70 percent.  Although the rabid Republican base are overwhelmingly racist, sexist, homophobic, and xenophobic, I think that there are millions of rank and file Republicans who are decent people, who pay absolutely no attention to politics, seldom, if ever, watch the news, watch Faux Noise when they do, and have no inkling of the evil Trump represents.  Many vote Republican out of family tradition.

Fortunately I slept for eight hours on Thursday night and ten hours last night, because it’s an incredibly busy day.  This morning I cooked food, did dishes, restocked my pill caddy, changed our poll, and researched for todays articles.  I also collected all the raw data and prepared all the graphics and charts for September’s Monthly Report.  That report will be a day late on Monday, because tomorrow I have TomCat and apartment cleaning with Wendy.  Also, tomorrow is a holy day in the Church of the Ellipsoid Orb.  My Broncos are visiting the Buccaneers’  Sadly, the meditation won’t be televised here.  May the Holy Orb shine its blessed light on your team, unless they say "HAR!!"

From Daily Kos: The state of Wisconsin is under a court order to provide credentials for people who don’t have the extensive documentation the state is requiring to get an approved ID for voting. Ari Berman has discovered that it’s not complying.

Legal experts say they’re extremely troubled by the state’s continued failure to fairly enforce the voter-ID law. “Wisconsin has promised the court that voters would be able to get an ID with whatever documents they have,” says Sean Young of the ACLU. “They’ve completely failed to live up to that promise.”

The state keeps frantically changing its procedures to mollify the courts, leading to even more confusion among voters. Last week the Walker Administration proposed issuing “voting purposes only” IDs that could not be used for anything else, like opening a bank account. “The Division of Motor Vehicles also wants the free IDs—born of voter-fraud fears – to be cheapened in quality, with some fraud protections removed,” the Milwaukee Journal Sentinel reported.

“The more they change the procedures, the clearer it becomes that this has nothing to do with voter impersonation,” Young says. “The whole process has no meaning anymore. It’s just a pointless obstacle to the right to vote.”

From NY Times: Nine months after instructing Alabama’s probate judges to defy federal court orders on same-sex marriage, Roy S. Moore, the chief justice of the Alabama Supreme Court, was suspended on Friday for the remainder of his term for violating the state’s canon of judicial ethics.

It was the second time in his contentious career that Judge Moore, an outspoken conservative, was removed as chief justice, and it followed his most recent star turn in the nation’s culture wars.

The suspension was imposed by the state’s Court of the Judiciary, a nine-member body of selected judges, lawyers and others, which found Judge Moore guilty on six charges. While the court did not take him off the bench entirely, as it did in 2003 after he defied orders to remove a giant Ten Commandments monument from the state judicial building, it effectively ended his state judicial career. His term ends in 2019, and Judge Moore, 69, will be barred by law from running for a judicial position again because of his age.

Good riddance to bad rubbish!

I have time to do a little more than I thought I would, but this is still today’s only article from me.  I’ll publish it after I return from my appointment with Megan.  I leave in an hour.

I’m back.  My 30 minute appointment took only 5 hours.  Megan agreed that I was right to discontinue Cymbalta and is putting me on Lyrica next.  It should come in mid-week, and I can take Gabapentin in the meantime.  I am sooooo pooped!!

From The New Yorker: Asked at a town-hall meeting on Wednesday to name his favorite foreign leader, the Libertarian Presidential candidate Gary Johnson seemed stumped at first before finally responding, “Obi-Wan Kenobi.”

The host of the town hall, MSNBC’s Chris Matthews, initially appeared taken aback by Johnson’s answer, but the former New Mexico governor went on to defend it vigorously.

“Obi-Wan Kenobi is a Jedi Master, Chris,” Johnson said. “More than anyone else, he taught me that the Force is already strong with me.”

LOL Andy, but you and Colbert are after widdle Gary?!!? The SPCI is going to get you both!!  That’s Society for the Prevention of Cruelty to Imbeciles!!

Getting my Lift permit renewed this morning took ten minutes.  Factoring-in waiting for rides, it took three and a half hours.  ARGH!!  I’m very tired, but as the effects of the Cymbalta are starting to wear off, I’m feeling a bit more human, and I know tomorrow’s appointment with Megan will limit me to a Personal Update.

That’s great news for America, especially since it shows a shift in support away from the minor candidates, whose candidacies help Trump.

From NY Times: Congress averted a government shutdown Wednesday as the Senate and then the House approved a short-term spending bill, allowing lawmakers to avoid a crisis and return home to campaign.

The stopgap spending bill, which would fund the government through Dec. 9, had been ensnarled in a debate over financing for the lead-tainted water system in Flint, Mich.

But an agreement between congressional leaders late Tuesday — which would authorize aid for Flint as part of separate legislation for water infrastructure projects — appeared to ameliorate Democratic concerns, clearing the way for the Senate to pass the spending bill, 72 to 26. The House followed suit late Wednesday, approving the measure 342 to 85.

I’m glad a government shutdown was avoided, but I am skeptical of any measure that includes the Democratic benefits as part of future legislation, especially when Senators Debbie Stabenow (D-MI) and Gary Peters (D-MI) oppose it. I am skeptical,because of the Republican track record for honoring agreements: virtually never.

From Think Progress: Donald Trump’s campaign manager appeared to unwittingly confirm an explosive Newsweek story on Thursday, telling ABC’s The View that a Trump company did indeed spend money in Cuba in 1998, in violation of a longstanding U.S. embargo that Trump has vociferously defended.

Newsweek’s Kurt Eichenwald reported on Thursday that Trump Hotels & Casino Resorts spent at least $68,000 in 1998 in Cuba, “at a time when the corporate expenditure of even a penny in the Caribbean country was prohibited without U.S. government approval.” The story notes that “with Trump’s knowledge, executives funneled the cash for the Cuba trip through an American consulting firm.” After the consultants traveled to Cuba and spent the funds, the consultants instructed Trump’s company on “how to make it appear legal by linking it after the fact to a charitable effort.”

As I have opposed the embargo of Cuba for many years, I would have supported doing business with that nation as an act of civil disobedience, as Michael Moore did, but Trump violating the law, at the same time that he campaigns to reinstate the embargo, is both hypocritical and criminal. It should disqualify his candidacy without further ado.

I’ve decided to stop taking Cymbalta, so my system will be clear for the next option, when I see Megan on Friday.  It’s been a week and a half, none of the side effects has abated, and as my system has gotten used to it, it has become less effective at blocking phantom pain.  I was up with it most of the night.  Today is a busy one.  Store to Door is coming this afternoon with my grocery delivery, and I’ll have to unpack and put it away.  Later Wendy is coming to de-stink the TomCat.  Tomorrow and Friday may be days with only a Personal Update.  Tomorrow I have to go to the Tri-Met office to prove my disability for Lift Bus authorization renewal.  I wonder if they think I might have grown my leg back.  Friday is my appointment with Megan.

From The New Yorker: Plunging the future of the 2016 Presidential debates into doubt, Donald J. Trump said on Tuesday morning that he would not participate in the remaining two debates if Hillary Clinton is there.

Trump blasted the format of Monday night’s debate by claiming that the presence of Clinton was “specifically designed” to distract him from delivering his message to the American people.

“Every time I said something, she would say something back,” he said. “It was rigged.”

He also lambasted the “underhanded tactics” his opponent used during the debate. “She kept on bringing up things I said or did,” he added. “She is a very nasty person.”

Amen, Andy. I can see the possibility that he might tuck tail and run away.

From Daily Kos: House Speaker Paul Ryan once again showed what a total weasel he is in his assessment of Donald Trump’s debate performance. Ryan offered up a glowing review:

“I saw Donald Trump give a spirited voice to those of us who don’t like the status quo, and I see emerging in front of us the potential for what a unified Republican government can get you, which can be the solutions,” Ryan said at a news conference Tuesday. “I think he passed a number of thresholds… and showed that for 90 minutes he could go toe-to-toe with Hillary Clinton.”

With Lyin’ Ryan, the truth of his statements is easy to discern. When he speaks, the opposite of what he says is true.
