{"id":8972,"date":"2012-09-30T10:28:43","date_gmt":"2012-09-30T17:28:43","guid":{"rendered":"http:\/\/www.politicsplus.org\/blog\/?p=8972"},"modified":"2012-09-30T10:28:43","modified_gmt":"2012-09-30T17:28:43","slug":"scotus-new-term","status":"publish","type":"post","link":"https:\/\/www.politicsplus.org\/blog\/2012\/09\/30\/scotus-new-term\/","title":{"rendered":"SCOTUS: New Term"},"content":{"rendered":"<p><font color=\"#0000ff\">The Supreme Court of the United States (SCOTUS) begins a new term, and with it the possibility of further undermining the Constitution of the United States, as they did in <em>Citizens United<\/em>, the worst Supreme Court decision since Dred Scott.&#160; As the Justices (and the inJustices) ponder important cases, we should be pondering just how important the coming election looms.<\/font><\/p>\n<blockquote>\n<p style=\"line-height: normal; margin: 0in; font-family: \"><font style=\"font-size: 12pt\"><img loading=\"lazy\" decoding=\"async\" style=\"display: block; float: none; margin-left: auto; margin-right: auto\" title=\"ScotusNew\" alt=\"ScotusNew\" src=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2012\/09\/ScotusNew.jpg\" width=\"537\" height=\"673\" \/><\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \"><font style=\"font-size: 12pt\">On Monday, the Supreme Court opens <a href=\"http:\/\/www.scotusblog.com\/case-files\/terms\/ot2012\/\" target=\"_blank\">a new term<\/a><font color=\"#0066cc\"><\/font> with a menu of important cases that deal with affirmative action, criminal justice, the right of defendants to effective counsel and more. The court may soon choose to hear a controversial case that could redefine voting-rights law, and, later in the term, one or more cases involving same-sex marriage.<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \"><span><strong><font style=\"font-size: 12pt\">AFFIRMATIVE ACTION <\/font><\/strong><\/span><font style=\"font-size: 12pt\">In <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/fisher-v-university-of-texas-at-austin\/\" target=\"_blank\">Fisher v. University of Texas at Austin<\/a><font color=\"#0066cc\"><\/font>, the court will address how and perhaps whether the university can take race into account as a factor in student admissions\u2026 <\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \"><span><strong><font style=\"font-size: 12pt\">UNREASONABLE SEARCHES <\/font><\/strong><\/span><font style=\"font-size: 12pt\">Two important cases involve the Fourth Amendment prohibition against unreasonable searches and seizures\u2026<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \"><span><strong><font style=\"font-size: 12pt\">RIGHT TO COUNSEL <\/font><\/strong><\/span><font style=\"font-size: 12pt\">Two cases involve the right of defendants to have effective counsel&#8230;<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \"><font style=\"font-size: 12pt\">The court has <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/shelby-county-v-holder\/\" target=\"_blank\">not yet considered<\/a><font color=\"#0066cc\"><\/font> whether to take a highly contested case about the Voting Rights Act, but it may\u2026 [<span><em>emphasis original<\/em><\/span>]<\/font><\/p>\n<\/blockquote>\n<p>Inserted from &lt;<a href=\"http:\/\/www.nytimes.com\/2012\/09\/30\/opinion\/sunday\/october-term-2012.html\" target=\"_blank\">NY Times<\/a>&gt;<\/p>\n<p><font color=\"#0000ff\">For more information on the Court\u2019s calendar <\/font><font color=\"#0000ff\">and cases than I intended to include, click through to the original article.&#160; My intent is to give you some concept of the magnitude of the importance of this election in determining the future of this nation.&#160; A Romney win, yielding a court where the extreme right has a 6-3 majority will change election rules so profoundly, that elections will no longer matter in this country.
