{"id":7491,"date":"2012-03-28T12:44:43","date_gmt":"2012-03-28T19:44:43","guid":{"rendered":"http:\/\/www.politicsplus.org\/blog\/?p=7491"},"modified":"2012-03-28T12:44:43","modified_gmt":"2012-03-28T19:44:43","slug":"looking-ugly-at-scotus","status":"publish","type":"post","link":"https:\/\/www.politicsplus.org\/blog\/2012\/03\/28\/looking-ugly-at-scotus\/","title":{"rendered":"Looking Ugly at SCOTUS"},"content":{"rendered":"<p><font color=\"#0000ff\">Far be it from me to predict final outcome of the Supreme Court\u2019s final determination on the constitutionality of the Affordable Care Act (ACA).&#160; However, based on the arguments from the first two days, it\u2019s looking ugly.&#160; My best guess is that they will overturn it, but don\u2019t ask me to bet on it.<\/font><\/p>\n<blockquote>\n<p><img loading=\"lazy\" decoding=\"async\" style=\"background-image: none; border-right-width: 0px; padding-left: 0px; padding-right: 0px; display: inline; float: left; border-top-width: 0px; border-bottom-width: 0px; border-left-width: 0px; padding-top: 0px\" title=\"28HCR\" border=\"0\" alt=\"28HCR\" align=\"left\" src=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2012\/03\/28HCR.jpg\" width=\"360\" height=\"269\" \/>With the fate of President Obama\u2019s health care law hanging in the balance, a lawyer for the administration faced <a href=\"http:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/11-398-Tuesday.pdf\" target=\"_blank\">a barrage of skeptical questions<\/a> on Tuesday from four of the Supreme Court\u2019s more conservative justices, <strong>suggesting that a 5-to-4 decision to strike down the law was a live possibility<\/strong>.<\/p>\n<p>Predicting the result in any Supreme Court case, much less one that will define the legacies of a president and a chief justice, is nothing like a science, and the case could still turn in various directions. But the available evidence indicated that the heart of the Affordable Care Act is in peril. <\/p>\n<p>The court\u2019s <strong>decision is expected by June<\/strong>, and much may change as the justices deliberate and exchange draft opinions in the coming months. <\/p>\n<p>If the indications from Tuesday\u2019s arguments are correct, though, the ruling may undo parts or all of the overhaul of the health insurance system, deal Mr. Obama a political blow in the midst of the presidential election season, and <strong>revise the constitutional relationship between the federal government and the states<\/strong>. <\/p>\n<p>The tone on Tuesday made a question to be addressed in the third and final day of arguments on Wednesday all the more important: If the individual mandate requiring most Americans to obtain health insurance or pay a penalty fell, what other parts of the law would fall along with it? <\/p>\n<p>On Tuesday, Justice <strong>Anthony M.
