{"id":6617,"date":"2012-01-01T00:01:42","date_gmt":"2012-01-01T08:01:42","guid":{"rendered":"http:\/\/www.politicsplus.org\/blog\/?p=6617"},"modified":"2012-01-01T00:01:42","modified_gmt":"2012-01-01T08:01:42","slug":"obamas-new-year-message-and-the-ndaa","status":"publish","type":"post","link":"https:\/\/www.politicsplus.org\/blog\/2012\/01\/01\/obamas-new-year-message-and-the-ndaa\/","title":{"rendered":"Obama&#8217;s New Year Message and the NDAA"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" style=\"background-image: none; border-right-width: 0px; padding-left: 0px; padding-right: 0px; display: block; float: none; border-top-width: 0px; border-bottom-width: 0px; margin-left: auto; border-left-width: 0px; margin-right: auto; padding-top: 0px\" title=\"Obama Year Four\" border=\"0\" alt=\"Obama Year Four\" src=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2012\/01\/1Obama.jpg\" width=\"605\" height=\"328\" \/><\/p>\n<p><font color=\"#0000ff\">Yesterday, President Barack Obama addressed the nation briefly.&#160; Here are my thoughts and the video of that address, or, if you prefer, you can <a href=\"http:\/\/www.esoterically.net\/weblog\/2011\/12\/31\/weekly-address-12-31-11\/\" target=\"_blank\">read the complete transcript<\/a>.&#160; In addition, I have some research on the NDAA.<\/font><\/p>\n<p><font color=\"#0000ff\"><iframe loading=\"lazy\" height=\"360\" src=\"http:\/\/www.youtube.com\/embed\/tkbSON2C8_M?rel=0\" frameborder=\"0\" width=\"640\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/font><\/p>\n<p><font color=\"#0000ff\">I think he gave too much credit to Republicans, who gave in, because not to do so would have been political suicide.&#160; <\/font><\/p>\n<p><font color=\"#0000ff\">I am pleased that Obama intends to do what he can in 2012 to help the economy by executive order, rather than trying to negotiate with Republicans, who have repeatedly shown their willingness to sabotage America to hurt Obama.<\/font><\/p>\n<p><font color=\"#0000ff\">I am disappointed that, at the last moment, Obama signed the Defense Budget,&#160; that contains the infamous NDAA.&#160; However, it does contain an amendment that it cannot <\/font><a href=\"http:\/\/www.lawfareblog.com\/2011\/12\/ndaa-passage-final-transcript-from-senate-floor\/\" target=\"_blank\">affect existing law or authorities relating to the detention of United States citizens or lawful resident aliens of the United States or any other persons who are captured or arrested in the United States<\/a><font color=\"#0000ff\">.&#160; The Non-Detention Act of 1971 does not permit the indefinite detention of US citizens.&#160; Realistically a veto would have done no good, as the margins by which the measure passed both houses is sufficient to override the veto.&#160; Congressional Democrats lack the stomach for a hostage situation involving defunding the entire military in an election year, and they believe the amendment noted above removes threat of indefinite detention of US citizens.<\/font><\/p>\n<p><font color=\"#0000ff\">From the signing statement:<\/font><\/p>\n<blockquote>\n<p>\u2026Section 1021 affirms the executive branch&#8217;s authority to detain persons covered by the 2001 Authorization for Use of Military Force (AUMF) (Public Law 107-40; 50 U.S.C. 1541 note). This section breaks no new ground and is unnecessary. The authority it describes was included in the 2001 AUMF, as recognized by the Supreme Court and confirmed through lower court decisions since then. Two critical limitations in section 1021 confirm that it solely codifies established authorities. First, under section 1021(d), the bill does not &quot;limit or expand the authority of the President or the scope of the Authorization for Use of Military Force.&quot; Second, under section 1021(e), the bill may not be construed to affect any &quot;existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States.&quot; My Administration strongly supported the inclusion of these limitations in order to make clear beyond doubt that the legislation does nothing more than confirm authorities that the Federal courts have recognized as lawful under the 2001 AUMF. Moreover, I want to clarify that my Administration will not authorize the indefinite military detention without trial of American citizens. Indeed, I believe that doing so would break with our most important traditions and values as a Nation.
