{"id":5920,"date":"2011-09-23T00:38:37","date_gmt":"2011-09-23T07:38:37","guid":{"rendered":"http:\/\/www.politicsplus.org\/blog\/?p=5920"},"modified":"2011-09-23T00:38:37","modified_gmt":"2011-09-23T07:38:37","slug":"a-battle-lost-but-the-struggle-goes-on","status":"publish","type":"post","link":"https:\/\/www.politicsplus.org\/blog\/2011\/09\/23\/a-battle-lost-but-the-struggle-goes-on\/","title":{"rendered":"A battle lost, but the struggle goes on!"},"content":{"rendered":"<p><font color=\"#0000ff\">During my trip to the state penitentiary where I do volunteer work, I talked so several men about the murder of Troy Davis.&#160; They felt devastated and frustrated that they could not sign petitions, make phone calls and do other things to fight for his life&#160; They knew that I have advocated for Troy\u2019s life for over two years, and asked me how the frustration would effect me.&#160; I told them this was a battle lost, but the struggle goes on until the US abandons this barbaric practice.&#160; Below you will find a couple right wing reactions, a compelling argument from Keith Olbermann, and an introduction to a case that may be the next one to capture international attention.<\/font><\/p>\n<p><font color=\"#0000ff\">There was no shortage of InsaniTEA.&#160; <a href=\"http:\/\/www.rightwingwatch.org\/content\/tea-party-nation-real-injustice-troy-davis-wasn%E2%80%99t-executed-sooner\" target=\"_blank\">Tea Party Nation said the real injustice is that Troy was not executed sooner<\/a>.<\/font><\/p>\n<p><font color=\"#0000ff\">The following is about the delay in the last hours before the murder.&#160; Apparently Clarence Thomas and Antonin Scalia objected to any consideration whatsoever.&#160; Here is Scalia\u2019s twisted rationale from <a href=\"http:\/\/freakoutnation.com\/2011\/09\/22\/justice-scalia-states-it-is-not-unconstitutional-to-execute-the-innocent\/\" target=\"_blank\">Freakout Nation<\/a>.<\/font><\/p>\n<blockquote>\n<p style=\"line-height: normal; margin: 0in; font-family: \" align=\"left\"><font face=\"Book Antiqua\"><font style=\"font-size: 12pt\">The Supreme Court today invoked a rarely used procedure giving Davis an <\/font><\/font><font style=\"font-size: 12pt\"><a href=\"http:\/\/www.scotusblog.com\/wp\/hearing-on-innocence-claim-ordered\/\" target=\"_blank\">opportunity to challenge his conviction<\/a><font color=\"#0066cc\" face=\"Book Antiqua\"><\/font><font face=\"Book Antiqua\">. Joined by Justice Clarence Thomas in dissent, however, Justice Antonin Scalia <\/font><a href=\"http:\/\/supremecourtus.gov\/opinions\/08pdf\/08-1443Scalia.pdf\" target=\"_blank\">criticized his colleagues<\/a><font color=\"#0066cc\" face=\"Book Antiqua\"><\/font><\/font><font face=\"Book Antiqua\"><font style=\"font-size: 12pt\"> for thinking that mere innocence is grounds to overturn a conviction:<\/font><\/font><\/p>\n<p style=\"line-height: normal; margin: 0in 0in 0in 0.375in; font-family: \" align=\"left\"><font face=\"Book Antiqua\"><span style=\"text-align: left\"><strong><font style=\"font-size: 12pt\">This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is \u201cactually\u201d innocent.<\/font><\/strong><\/span><font style=\"font-size: 12pt\">&#160; Quite to the contrary, we have repeatedly left that question unresolved, while expressing considerable doubt that any claim based on alleged \u201cactual innocence\u201d is constitutionally cognizable<\/font><\/font><\/p>\n<\/blockquote>\n<p style=\"line-height: normal; margin: 0in 0in 0in 0.375in; font-family: \" align=\"left\"><font face=\"Book Antiqua\"><font style=\"font-size: 12pt\">\u2026 [<span style=\"text-align: left\"><em>emphasis original<\/em><\/span>]<\/font><\/font><\/p>\n<p><font color=\"#0000ff\"><\/font><\/p>\n<p><font color=\"#0000ff\">How absurd!&#160; What better evidence could there be of the need to keep a Democrat in the White House until Injustices Roberts, Alito, Scalia, Thomas, and Kennedy have been replaced with Justices.<\/font><\/p>\n<p><font color=\"#0000ff\">Keith Olbermann and Liliana Segura provided a compelling argument opposing capital punishment on <a href=\"http:\/\/current.com\/shows\/countdown\/\" target=\"_blank\">Countdown<\/a>.<\/font><\/p>\n<p><font color=\"#0000ff\"><iframe loading=\"lazy\" height=\"480\" src=\"http:\/\/www.youtube.com\/embed\/FwPTlY9JCII?rel=0\" frameborder=\"0\" width=\"640\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/font><\/p>\n<p><font color=\"#0000ff\">Darrow was right!<\/font><\/p>\n<p><font color=\"#0000ff\">Now, here is a case that could be the next high profile fight.<\/font><\/p>\n<blockquote>\n<p style=\"line-height: normal; margin: 0in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\"><img loading=\"lazy\" decoding=\"async\" style=\"background-image: none; border-right-width: 0px; padding-left: 0px; padding-right: 0px; display: inline; float: left; border-top-width: 0px; border-bottom-width: 0px; border-left-width: 0px; padding-top: 0px\" title=\"23Clemons\" border=\"0\" alt=\"23Clemons\" align=\"left\" src=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2011\/09\/23Clemons.jpg\" width=\"360\" height=\"256\" \/>Yes, <a href=\"http:\/\/crooksandliars.com\/breaking-news\/troy-davis-dead-1108-pm-est\" target=\"_blank\">Troy Davis has been killed<\/a><font color=\"#0066cc\"><\/font>, after a roller coaster ride through the end stages of an execution. But he <a href=\"http:\/\/redantliberationarmy.wordpress.com\/2011\/09\/11\/to-all-a-message-from-troy-anthony-davis\/\" target=\"_blank\">left a message behind<\/a><font color=\"#0066cc\"><\/font>, which said this, in part:<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in 0in 0in 0.375in; font-family: \" align=\"left\"><span style=\"text-align: left\"><strong><font style=\"font-size: 12pt\"><font color=\"#ff0000\">This fight to end the death penalty is not won or lost through me but through our strength to move forward and save every innocent person in captivity around the globe<\/font>. <\/font><\/strong><\/span><font style=\"font-size: 12pt\">We need to dismantle this Unjust system city by city, state by state and country by country.<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in 0in 0in 0.375in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\">I can\u2019t wait to Stand with you, no matter if that is in physical or spiritual form, I will one day be announcing,<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in 0in 0in 0.375in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\">\u201cI AM TROY DAVIS, and I AM FREE!\u201d<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\">I want to take him at his word, and as it turns out, right after I wrote my final post about Troy&#8217;s execution, someone suggested I look at Reginald Clemons&#8217; case, pending in Missouri.<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\">The more I look at it, the more I&#8217;m gobsmacked by the idea of this man ending up on Death Row when he was never convicted of the crime committed &#8212; the rape and murder of two white teenagers. Under the prosecutor&#8217;s theory of the case, Clemons was an accomplice. It is a case with a lot of twists and turns in it, but there are facts which have been clearly established. The fact sheet with the entire story is <a href=\"http:\/\/www.justiceforreggie.com\/wp-content\/uploads\/2009\/06\/long_fact_sheet.pdf\" target=\"_blank\">here<\/a><font color=\"#0066cc\"><\/font>. I suggest you read it before going further.<\/font><\/p>\n<p style=\"line-height: normal; margin: 0in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\">Here&#8217;s some of what you will learn:<\/font><\/p>\n<ul style=\"line-height: normal; margin-top: 0in; padding-left: 0px; unicode-bidi: embed; direction: ltr; margin-bottom: 0in; margin-left: 0.75in\" type=\"disc\">\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\">At the time of the crime, Reggie Clemons had a clean record, was in school studying to become a mechanic. There does not appear to be any common link between the victims, Clemons, or his friends.<\/font><\/span> <\/li>\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\">The original suspect was a cousin of the victims, Thomas Cummins, who eventually implicated himself in the crime after his initial story came up short. <strong>Charges against Cummins were dropped and charges brought against the three African-American teenagers who were in the area that night<\/strong>. Clemons was one.<\/font><\/span> <\/li>\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\"><strong>Police beat Clemons, denied him an attorney after he asked for one, and coerced a statement from him<\/strong>, admitting to rape of the girls but not pushing them off the bridge.<\/font><\/span> <\/li>\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\"><strong>Thomas Cummins retracted his confession, claiming it had been beaten out of him. He settled his police brutality complaint and prosecutors dropped all charges<\/strong>. <strong>They ignored Clemons and his co-defendants&#8217; claims of police brutality, dropped the rape charges, and charged them all with capital murder<\/strong>. Clemons charges stemmed from their theory of the case; namely, that he was an accessory to murder by virtue of being in the same location.<\/font><\/span> <\/li>\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\">Reggie Clemons had extraordinarily ineffective attorneys. One of them was practicing tax law in California while returning to Missouri for court appearances.<\/font><\/span> <\/li>\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\"><strong>The prosecutor improperly excluded African-American jurors from the panel<\/strong>. It was so egregious he was later sanctioned for it.<\/font><\/span> <\/li>\n<li style=\"margin-top: 0px; margin-bottom: 0px; vertical-align: middle\"><span style=\"font-family: \"><font style=\"font-size: 12pt\">One of his co-defendants, Marlin Gray, was executed in 2009.<\/font><\/span> <\/li>\n<\/ul>\n<p style=\"line-height: normal; margin: 0in; font-family: \" align=\"left\"><font style=\"font-size: 12pt\">There&#8217;s more. But this gives you a flavor of what this case is about. As if all of that isn&#8217;t bad enough, there&#8217;s this nugget, discovered after 8th Circuit Court of Appeals stayed his execution: <a href=\"http:\/\/www.ksdk.com\/news\/local\/story.aspx?storyid=197452\" target=\"_blank\">There is a rape kit<\/a><font color=\"#0066cc\"><\/font> from one of the victims in the police evidence room that has <strong>never been tested and was never brought forth at trial. A rape kit! Something that would have proven or disproven Reggie Clemons&#8217; coerced confession<\/strong>.
