How did you do?<\/span><\/p>\r\n<p><span style=\"color: #0000ff;\"><strong>Short Takes<\/strong><\/span><\/p>\r\n<p><a href=\"https:\/\/www.alternet.org\/news-amp-politics\/federal-judge-texas-rules-all-obamacare-be-unconstitutional\"><strong><span style=\"color: #0000ff;\">AlterNet<\/span><\/strong><\/a> &#8212;\u00a0In a ruling that was quickly dubbed as &#8220;insane&#8221; by critics, a federal judge in Texas ruled that the entirety of the Affordable Care Act \u2014 also known as &#8220;Obamacare&#8221; \u2014 was unconstitutional.<\/p>\r\n<p>It appears the law will still technically be in place while the case goes through appeals, however.<\/p>\r\n<p>Judge Reed O&#8217;Connor had been expected to rule against the law, brought by Republican states attorneys general, but the scope of his ruling Friday night still shocked many observers. The lawsuit he heard targeted the law&#8217;s individual mandate, which sets a tax penalty for every who American who doesn&#8217;t sign up for health insurance.<\/p>\r\n<p>The mandate had already been upheld by the Supreme Court, so it would have seemed that the lawsuit was pointless. It seems even more pointless because last year the Republicans voted to set the cost of the individual mandate to zero, effectively nullifying it.<\/p>\r\n<p><span style=\"color: #0000ff;\">Click through . . . it gets even more insane.\u00a0 Judge O&#8217;Connor\u00a0is a United States District Judge of the United States District Court for the Northern District of Texas and was nominated by George W. Bush in 2007.\u00a0 If this was a lifetime appointment, he has a long way to go before retirement since he is only 53 years old.\u00a0 <a href=\"https:\/\/thinkprogress.org\/breaking-republican-judge-issues-order-striking-down-obamacare-967945c56a97\/\"><strong>Think Progress<\/strong><\/a> had this to say about O&#8217;Connor:<\/span><\/p>\r\n<blockquote>\r\n<p>The Republican officials filed their case in Fort Worth, Texas, where the\u00a0<a href=\"http:\/\/www.txnd.uscourts.gov\/location\/fort-worth\">only active federal district judge<\/a>\u00a0is Reed O\u2019Connor, a\u00a0<a href=\"https:\/\/www.motherjones.com\/politics\/2018\/11\/obamacare-lawsuit-donald-trump-midterm-election-preexisting-conditions\/\">highly partisan judge<\/a>\u00a0with a long history of\u00a0<a href=\"https:\/\/thinkprogress.org\/obamacare-repeal-lawsuit-republican-governors-attorneys-general-2aef6cde8775\/\">striking down Democratic policies on spurious legal reasoning<\/a>.<\/p>\r\n<\/blockquote>\r\n<p><span style=\"color: #0000ff;\">Of course, this morning, Trump has jumped in on this decision with his usual plethora of lies with his tweets.\u00a0 Responses to his tweets can be seen <a href=\"https:\/\/www.alternet.org\/news-amp-politics\/americans-rally-behind-obamacare-trump-calls-supreme-court-kill-healthcare\" target=\"_blank\" rel=\"noopener\"><strong>HERE<\/strong><\/a> and they are good!\u00a0 A sac of hammers would appear to have more brains than O&#8217;Connor.<\/span><\/p>\r\n<p><span style=\"color: #0000ff;\"><a href=\"https:\/\/thinkprogress.org\/amid-swirling-trump-scandals-cummings-backs-rules-change-to-allow-indictment-of-a-sitting-president-384d0c9386ed\/\"><strong>Think Progress<\/strong><\/a> &#8212;\u00a0\u00a0<\/span>Rep. Elijah Cummings (D-MD), the Democrat who takes over chairmanship of the House Oversight Committee next month, called Sunday for the overhaul of legal guidelines that currently protect presidents from criminal prosecution.<\/p>\r\n<p>\u201cI think we should always reconsider laws and regulations, and this is one we definitely should reconsider,\u201d\u00a0Cummings told CNN\u2019s\u00a0<em>State of the Union<\/em>. &#8230;<\/p>\r\n<p><iframe loading=\"lazy\" width=\"695\" height=\"391\" src=\"https:\/\/www.youtube.com\/embed\/F18fft2im_M?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/p>\r\n<p>As\u00a0<a href=\"https:\/\/www.washingtonpost.com\/politics\/mounting-legal-threats-surround-trump-as-nearly-every-organization-he-has-led-is-under-investigation\/2018\/12\/15\/4cfb4482-ffbb-11e8-862a-b6a6f3ce8199_story.html?utm_term=.37b7a13585e5\">The Washington Post<\/a>\u00a0reported this weekend, nearly every organization touched by Donald Trump over the past decade \u2014 both civil and governmental \u2014 is currently under investigation. And as ThinkProgress has\u00a0<a href=\"https:\/\/thinkprogress.org\/trump-favorite-excuse-for-wrongdoing-didnt-know-about-it-4a036eced607\/\">reported<\/a>, the administration has been beset by an unending parade of scandals.\u00a0 &#8230;<\/p>\r\n<p>Cummings also echoed\u00a0<a href=\"https:\/\/thehill.com\/homenews\/administration\/421171-adam-schiff-doj-must-re-examine-olc-opinion-that-you-cannot-indict-a\">remarks<\/a>\u00a0by fellow Democratic Rep. Adam Schiff (CA), who is poised to become chairman of the House Intelligence Committee.\u00a0Schiff\u00a0told CNN last week\u00a0that the Office of Legal Counsel in the DOJ should revisit the policy against indicting presidents.<\/p>\r\n<p>\u201cI think the Justice Department needs to reexamine that Office of Legal Counsel opinion, that you cannot indict a sitting president under circumstances in which the failure to do so may mean that person escapes justice,\u201d the California Democrat said.<\/p>\r\n<p><span style=\"color: #0000ff;\">It seems that it is going to be a fish fry starting in January and I can already hear the sizzling from the pan and the gnashing of Republican teeth!<\/span><\/p>\r\n<p><a href=\"https:\/\/www.alternet.org\/news-amp-politics\/new-jersey-gerrymandering-defeated-democratic-pushback\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\"><strong>AlterNet<\/strong><\/span><\/a> &#8212;\u00a0Republicans are executing shameless power grabs in\u00a0<a href=\"https:\/\/www.nytimes.com\/2018\/12\/14\/us\/wisconsin-governor-scott-walker.html\">Wisconsin<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.cnn.com\/2018\/12\/06\/opinions\/wisconsin-michigan-north-carolina-gop-power-grab-avlon\/index.html\">Michigan<\/a>, passing laws stripping newly-elected Democrats and liberal activists of power on their way out the door and transferring them to the GOP legislatures. But some in the political pundit class, like NBC&#8217;s\u00a0<a href=\"https:\/\/www.mediamatters.org\/blog\/2018\/12\/10\/chuck-todd-falsely-claims-both-parties-engage-antidemocratic-power-grabs-gop-did-wisconsin-there-s\/222270\">Chuck Todd<\/a>, are pushing a narrative that rewriting the law to lock the other party out of electoral power is a common tactic that both parties use.<\/p>\r\n<p>In fact\u00a0<a href=\"https:\/\/www.mediamatters.org\/blog\/2018\/12\/10\/chuck-todd-falsely-claims-both-parties-engage-antidemocratic-power-grabs-gop-did-wisconsin-there-s\/222270\">it isn&#8217;t<\/a>. And this weekend, America saw the ultimate test of this false equivalence in New Jersey. Democratic activists in the state and around the country revolted against a plan that would have essentially been a Democratic version of the Wisconsin and Michigan power grabs \u2014 and forced lawmakers to\u00a0<a href=\"https:\/\/www.politico.com\/states\/new-jersey\/story\/2018\/12\/15\/intense-opposition-kills-redistricting-749296\">abandon<\/a>\u00a0their attack on fair elections.<\/p>\r\n<p>Democrats in the New Jersey legislature were moving forward with a\u00a0<a href=\"https:\/\/slate.com\/news-and-politics\/2018\/12\/new-jersey-gerrymandering-plan-bad.html\">plan<\/a>\u00a0that would have effectively written Democratic gerrymandering into the state constitution forever. Under this plan, half of legislative districts would be drawn to lean more Democratic, half to lean more Republican, and 25 percent of the total would be &#8220;competitive.&#8221; That sounds fair on paper, but the plan actually defined &#8220;competitive&#8221; as any district that comes within 5 points of the statewide vote for president, Senate, and governor \u2014 which is\u00a0<a href=\"https:\/\/web.archive.org\/web\/20180613111559\/https:\/\/decisiondeskhq.com\/news\/2016-state-pvi-changes\/\">7 points more Democratic<\/a> than the national average.
