{"id":31599,"date":"2018-02-27T13:10:45","date_gmt":"2018-02-27T21:10:45","guid":{"rendered":"http:\/\/www.politicsplus.org\/blog\/?p=31599"},"modified":"2018-02-27T13:10:46","modified_gmt":"2018-02-27T21:10:46","slug":"winning-gaily","status":"publish","type":"post","link":"https:\/\/www.politicsplus.org\/blog\/2018\/02\/27\/winning-gaily\/","title":{"rendered":"Winning Gaily!"},"content":{"rendered":"<p><font color=\"#0000ff\">It seems to be a week for good news.&#160; Yesterday we learned that the racist Latino hatred of Republican Reich suffered a major defeat when a Supreme Court guaranteed DACA for another year or more.&#160; Today we learned that the homophobic LGBT hatred of the Republican Reich suffered a major defeat when the courts defined discrimination in our LGBT friends&#8217; favor.<\/font><\/p>\n<blockquote>\n<p><img loading=\"lazy\" decoding=\"async\" title=\"0227GayFlag\" style=\"border-left-width: 0px; border-right-width: 0px; background-image: none; border-bottom-width: 0px; float: none; padding-top: 0px; padding-left: 0px; margin-left: auto; display: block; padding-right: 0px; border-top-width: 0px; margin-right: auto\" border=\"0\" alt=\"0227GayFlag\" src=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2018\/02\/0227GayFlag.jpg\" width=\"700\" height=\"366\" \/><\/p>\n<p>In a victory for LGBTQ Americans, a federal appeals court delivered a blow to the Trump administration&#8217;s Justice Department, ruling that <strong>the 1964 Civil Rights Act prohibits anti-gay discrimination in the workplace<\/strong>.<\/p>\n<p>In its ruling on Zarda vs. Altitude Express, the Second Circuit Court of Appeals, covering New York, Connecticut, and Vermont, <a href=\"https:\/\/www.vox.com\/identities\/2018\/2\/26\/17053874\/gay-rights-discrimination-second-circuit\" target=\"_blank\">argued<\/a> that &quot;a woman who is subject to an adverse employment action because she is attracted to women would have been treated differently if she had been a man who was attracted to women. <strong>We can therefore conclude that sexual orientation is a function of sex and, by extension, sexual orientation discrimination is a subset of sex discrimination<\/strong>.&quot;<\/p>\n<p>The Seventh Circuit Court reached a similar conclusion last year, becoming the <a href=\"https:\/\/www.eeoc.gov\/laws\/statutes\/titlevii.cfm\" target=\"_blank\">first<\/a> appeals court to argue that <strong>Title VII of the Civil Rights Act, which bars discrimination against employees based on &quot;race, color, religion, sex, or national origin,&quot; should be understood to protect LGBTQ Americans<\/strong>.<\/p>\n<p>&quot;There have now been two federal appeals courts to recognize what we&#8217;ve always known\u2014that discrimination based on sexual orientation is in fact discrimination, and that there is no room for it in the workplace,&quot; said Ria Tabacco Mar, staff attorney for the American Civil Liberties Union (ACLU), in a <a href=\"https:\/\/www.aclu.org\/news\/federal-appeals-court-rules-civil-rights-act-covers-sexual-orientation\">statement<\/a>. &quot;<strong>This decision is also a repudiation of the Trump administration&#8217;s Justice Department, which has insisted that LGBT discrimination is acceptable under federal law<\/strong>.&quot;<\/p>\n<p>The Trump administration, led by Attorney General Jeff Sessions, filed an <a href=\"https:\/\/cdn.vox-cdn.com\/uploads\/chorus_asset\/file\/8939771\/Zarda-DOJ-brief.0.pdf\">amicus brief<\/a> siding with the employer in the case of Zarda vs. Altitude Express.
