Sues Goldman Sachs"},"content":{"rendered":"<p><font color=\"#0000ff\">It\u2019s about time!<\/font><\/p>\n<blockquote>\n<p><a href=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2010\/04\/Goldman.jpg\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" style=\"border-right-width: 0px; margin: 2px 10px 5px 0px; display: inline; border-top-width: 0px; border-bottom-width: 0px; border-left-width: 0px\" title=\"Goldman\" border=\"0\" alt=\"Goldman\" align=\"left\" src=\"https:\/\/www.7thstep.org\/blog\/wp-content\/uploads\/2010\/04\/Goldman_thumb.jpg\" width=\"259\" height=\"353\" \/><\/a> Goldman Sachs, the Wall Street powerhouse, was accused of <strong>securities fraud<\/strong> in a <a href=\"http:\/\/www.sec.gov\/litigation\/complaints\/2010\/comp-pr2010-59.pdf\" target=\"_blank\">civil lawsuit<\/a> filed Friday by the Securities and Exchange Commission, which claims the bank created and sold a mortgage investment that was secretly intended to fail. <\/p>\n<p>The move was the first time that regulators had taken action against <strong><font color=\"#ff0000\">a Wall Street deal that helped investors capitalize on the collapse of the housing market<\/font><\/strong>. <\/p>\n<p>The suit also named Fabrice Tourre, a vice president at Goldman who helped create and sell the investment. <\/p>\n<p><a href=\"http:\/\/www2.goldmansachs.com\/our-firm\/press\/press-releases\/current\/response.html\" target=\"_blank\">In a statement<\/a>, Goldman called the commission\u2019s accusations \u201ccompletely unfounded in law and fact\u201d and said it would \u201cvigorously contest them and defend the firm and its reputation.\u201d <\/p>\n<p>The focus of the S.E.C. case, an investment vehicle called Abacus 2007-AC1, was <strong>one of 25 such vehicles that Goldman created so the bank and some of its clients could bet against the housing market<\/strong>. Those deals, which were the subject of an article in <a href=\"http:\/\/www.nytimes.com\/2009\/12\/24\/business\/24trading.html\" target=\"_blank\">The New York Times in December<\/a>, initially protected Goldman from losses when the mortgage market disintegrated and later yielded profits for the bank. <\/p>\n<p>As the Abacus portfolios in the S.E.C. case plunged in value, a prominent hedge fund manager made money from his bets against certain mortgage bonds, while investors lost more than $1 billion. <\/p>\n<p>According to the complaint, Goldman created Abacus 2007-AC1 in February 2007 at the request of John A. Paulson, a prominent hedge fund manager who earned an estimated $3.7 billion in 2007 by correctly wagering that the housing bubble would burst. <strong>Mr. Paulson is not named in the suit<\/strong>. <\/p>\n<p><strong>Goldman told investors that the bonds would be chosen by an independent manager. In the case of Abacus 2007-AC1, however, <font color=\"#ff0000\">Goldman let Mr. Paulson select mortgage bonds that he believed were most likely to lose value<\/font>, according to the complaint. <\/strong><\/p>\n<p><strong><font color=\"#ff0000\">Goldman then sold the package to investors like foreign banks, pension funds and insurance companies, which would profit only if the bonds gained value<\/font><\/strong>. The European banks IKB and ABN Amro and other investors lost more than $1 billion in the deal, the commission said. <\/p>\n<p>\u201cGoldman wrongly permitted a client that was betting against the mortgage market to heavily influence which mortgage securities to include in an investment portfolio,\u201d Robert Khuzami, the director of the commission\u2019s enforcement division, said in a written statement. <\/p>\n<p>The lawsuit could be a sign of a revitalized Securities and Exchange Commission, which has been criticized for early missteps in assessing the causes of the financial crisis. The agency appears to be tracing the mortgage pipeline all the way from the companies like Countrywide Financial that originated home loans to the raucous trading floors that dominate Wall Street\u2019s profit machine. <\/p>\n<p>At a conference in New Orleans on Friday, Mr. <a href=\"http:\/\/dealbook.blogs.nytimes.com\/2010\/04\/16\/s-e-c-inquiry-may-widen-khuzami-hints\/\" target=\"_blank\">Khuzami<\/a> indicated that he was scrutinizing other deals involving mortgage securities. \u201cWe\u2019re looking at a wide range of products,\u201d he said at a news conference. \u201cIf we see securities with similar profiles, we\u2019ll look at them closely.\u201d <\/p>\n<p>Shares of Goldman Sachs plunged more than 10 percent in just the first half-hour of trading after the suit was announced Friday morning.
