Tom Coburn (R-OK) and Rand Paul (R-KY) that could render it virtually <a href=\"http:\/\/www.coburn.senate.gov\/public\/index.cfm\/pressreleases?ContentRecord_id=e6bb76fa-b40a-40e2-a43c-2c8ebc005b5b&amp;ContentType_id=d741b7a7-7863-4223-9904-8cb9378aa03a&amp;Group_id=7a55cb96-4639-4dac-8c0c-99a4a227bd3a&amp;MonthDisplay=7&amp;YearDisplay=2013\" target=\"_blank\">impossible for Congress to enact any legislation intended to improve working conditions<\/a> or otherwise regulate the workplace. Had their bill been in effect during the Twentieth Century, for example, there would likely be <strong>no nationwide minimum wage, no national ban on workplace discrimination, no national labor law and no overtime in most industries<\/strong>.<\/p>\n<p>Like many <a href=\"http:\/\/www.americanprogress.org\/issues\/civil-liberties\/report\/2011\/09\/16\/10391\/what-if-the-tea-party-wins\/\" target=\"_blank\">Tea Party proposals to neuter the federal government<\/a>, Coburn and Paul\u2019s bill is marketed as an effort to bring America back in line with a long-ago discarded vision of the Constitution. It\u2019s named the \u201cEnumerated Powers Act of 2013,\u201d a reference to the provisions of the Constitution outlining Congress\u2019 specific powers, and it claims to require all federal legislation to \u201c\u2019contain a concise explanation of the specific authority in the Constitution\u2019 that is the basis for its enactment.\u201d<\/p>\n<p>The key provision in this bill, however, would revive a discredited interpretation of the Constitution that America abandoned nearly eight decades ago.
