DREAMers Can Celebrate

The reason that Democrats agreed to a deal preventing a government shutdown, without reaching a deal to safeguard DREAMers first, is that on January 9, Judge William Alsup ordered the Trump Reich to restart DACA, thus declaring Trump’s termination of DACA, unconstitutional, pending final judicial review, which in this case, can only end in the Supreme Court. The Trump Reich appealed and asked the Supreme Court to strike down Alsup’s injunction immediately.  They declined, so DREAMers can celebrate.  The March 5 deadline is no more.

The Supreme Court handed President Trump a significant defeat Monday, turning down the administration’s plea for a quick ruling on the president’s power to end special protections for so-called Dreamers.

The court’s decision not to hear the administration’s appeal immediately could keep in place a legal shield for the nearly 700,000 young immigrants for the rest of this year, and perhaps longer.

The Justice Department had sought to leapfrog the U.S. appeals courts in California and New York. The department had asked for an “immediate review” of a nationwide order by U.S. District Judge William Alsup in San Francisco that required the government to maintain for now the Obama-era program known as Deferred Action for Childhood Arrivals, or DACA.

The action the administration sought was rare. It has been nearly 30 years since the Supreme Court granted review of a district judge’s ruling before an appeals court could weigh in. And the court said Monday it had no interest in following that course in the DACA case.

The justices, without dissent, turned down the administration’s petition “without prejudice,” meaning that the government could return to the high court once the appeals court rules…

The Supreme Court’s case load for this year is now full, so the earliest it could rule on this case, after it goes through the appeals process, is over a year away.  DREAMERS can celebrate, because they are safe until then.  Hopefully, Democrats will have majorities in the House and the Senate by then.

  3. Very good news … which makes it even more important (if possible) for us to continue to fight for control of Congress before the Supreme Court can hear it.

  4. Saw this earlier, wonderful!  This also means that Gorsuch, once again, voted with his head, rather than tDump’s ass!

  5. Dreamers can now sleep more peacefully for another year with this reprieve. But we all need to remember that SCOTUS turned the plea for a quick ruling down because it bypassed two appeals courts, which isn’t normal procedure; there’s no reason to think that SCOTUS will either turn it down again or rule in favour of the Dreamers.

    In addition the government is now ordered to maintain DACA, which lets Republicans off the hook to come up with a solution for Drumpf ending the program. I’m sure by November they will turn Dreamers into a group they “vow to fight for” in their individual campaigns and abandon them again as soon as they are (re)elected. Duplicity, after all, is their middle name. No, strike that, it’s their first.

  6. This leapfrogging of the US appeals courts in California and New York sounds suspiciously like trying to circumvent due process.  Didn’t Drumpf just rail against the lack of due process when two staffers resigned over spousal abuse allegations?

    Peoples lives are being shattered and destroyed by a mere allegation. Some are true and some are false. Some are old and some are new. There is no recovery for someone falsely accused – life and career are gone. Is there no such thing any longer as Due Process?

    Yes indeed, good news but the final decision is unfortunately just kicked down the road by a year or so.  More anxious waiting!  If Democrats can tar and feather the Republicans in the 2018 mid terms sending them to the unemployment line, then real justice will be served!

    I’m certain that when SCROTUS finally does take up the matter, they will rule the wrong way, or better put, the Reich way!  It is critical that we resolve the matter, before that happens.
