I’m pleased to announce that the DOJ is finally filing a suit against the The Totalitarian Fascist Plutocracy of McCrorystan, led by TEAfuhrer Pat McCrory, for attempting to return what used to be North Carolina to the days of Jim Crow and beyond.  It’s about time!

The Justice Department is expected to sue North Carolina on Monday over its restrictive new voting law, further escalating the Obama administration’s efforts to restore a stronger federal role in protecting minority voters after the Supreme Court struck down part of the Voting Rights Act, according to a person familiar with the department’s plans.

The lawsuit, which had been anticipated, will ask a federal court to block North Carolina from enforcing four disputed provisions of its voting law, including a strict photo identification requirement. The lawsuit will also seek to reimpose a requirement that North Carolina obtain “preclearance” from the federal government before making changes to its election rules.

The court challenge will join similar efforts by the Justice Department’s Civil Rights Division in Texas over that state’s redistricting plan and voter photo ID law. Those lawsuits are seeking to return Texas to federal “preclearance” oversight.

In June, all five Republican-appointed Supreme Court justices voted to do away with a provision in the Voting Rights Act that required North Carolina, Texas and six other states with histories of discrimination, mostly in the South, to obtain permission from the Justice Department or a federal court before changing their election procedures. All four Democratic-appointed justices dissented

There are several more states that DOJ needs to sue, because Republicans want to make voting, while not white and Republican, a crime, and not all are in the South.  In my opinion, preclearance should be required in all fifty states, because one never knows where people might fall for Republican lies and turn over their voting mechanisms to racists.

  1. I nearly dropped my newspaper and started to applaud when I read Voting rights are guaranteed by the Constitution which RepubliCons claim to uphold. Oops! They must have skipped over that part of it.

  2. Excellent news – about time!

  3. As I recall from the June SCOTUS decision, the crux of the decision was on the formula used to determine which state did, and which state did not have to submit to pre-clearance of changes to voting rules.  And Congress had to come up with the new formula.  With today's Congress, there is not a hope in hell that they could  agree on a paint colour for the bathrooms, let alone a formula to determine whether pre-clearance were necessary for states.

The fair way is for ALL states to be subjected to pre-clearance.  Altholugh a pain in the ass for states with no history of voter discrimination, it does not mean that discrimination won't happen in the future.  Personally, I believe that for all federal elections, the laws for all states should be the same to prevent state to state advantages/disadvantages.  For example, why should the electorate in one state have significant early voting, but another state have virtually none.

I hope the DOJ takes all states that seek to restrict or suppress the right to vote to task.  Unlike Boehner's fight to uphold DOMA, this is a fight worth pursuing because it goes to the very rights of a representative democracy.

  4. The lawsuit will also seek to reimpose a requirement that North Carolina obtain “preclearance” from the federal government before making changes to its election rules.

    This is good news…
