Yesterday defrosting my freezer tired me to the extent that I was too tires to sleep.  Therefore, this will be today’s only article, as I’m going back to bed and try again.  I am not current with replies.  I expect to be back tomorrow.

From NY Times: A federal appeals court on Thursday ruled that gay Americans are a class of people who deserve the same kinds of constitutional protections as many other victims of discrimination.

The 2-to-1 ruling, by the Court of Appeals for the Second Circuit in New York, came as the panel struck down the federal law prohibiting federal recognition of same-sex marriage. It is the first time that a federal appeals court has applied this level of constitutional protection — known as heightened scrutiny — to those unions. The case is now considered by some legal scholars to be the leading candidate for a Supreme Court review of the same-sex marriage issue.

Thursday’s decision was the second by a federal appeals court striking down the Defense of Marriage Act. Now the case, Windsor v. United States, could be considered by the Supreme Court.

Another step toward freedom.

From 538: The Gallup national tracking poll now shows a very strong lead for Mitt Romney. As of Wednesday, he was ahead by six points among likely voters. Mr. Romney’s advantage grew further, to seven points, when Gallup updated its numbers on Thursday afternoon.

The Gallup poll is accounted for in the forecast model, along with all other state and national surveys.

However, its results are deeply inconsistent with the results that other polling firms are showing in the presidential race, and the Gallup poll has a history of performing very poorly when that is the case.

That 7% number didn’t ring true to me, because I have not seen a corresponding shift in the state by state polls.

  1. I find it very hard to believe that a majority of the American voters would elect Romney.  But then I thought that about George W Bush also…twice…and I was wrong both times.

  5. MoveOn ~ James Lipton was brilliant in this clip. I saw him on Hardball the other day. I found this write-up of a few of his interviews after the debates. He is looking for Rmoney's soul, I believe. He still hasn't found it.

      Sometimes a poll just screws the pooch.  I looked at the methodology and it looked OK.  That's why I like to use averages and trends.

    MoveOn — Very good.  Would have liked to hear the 'results' of the test — think it would be funny!  Many have accused Romney of many things — liar, greedy, power hungry etc etc — but I don't believe they have ever accused him of being a genuine compassionate human being!  I hear the term "plastic man" a lot.  I think if he decided to become a real and genuine human being, the world would stop rotating on it's axis!
     
    NY Times — Amen!  There is truth and justice!  Well at least outside SCOTUS.  With this progress, the Injustices of SCOTUS are likely to put an end to this ruling.  May the arguments be so compelling that the Injustices must rule to uphold the Appeals Court decisions.
     
    538 — Have the Republican/Teabaggers infiltrated the Gallup organisation?  Or maybe this is just a Hallowe'en trick to see if anyone is watching!
     
    Cartoon — Amazing that this embargo is still going on!  The enmity created over the past 52 years is beyond belief!  The Berlin Wall came down years ago.  It is time this 'wall' was broken down too!

      I think he is compassionate  when his role calls for compassion, such as pastoral duties.  He does not see capitalist or politician as compassionate roles.

  7. NY Times & Gay Marriage
    You got to love the Second Circuit Court's Ruling if only for the irony.
    If you read the NY Times piece, you learned that the suit was brought because Ms. Windsor contested the tax bill of $363,053 that she would have had to pay if her marriage had not been recognized.
    So the Wingnuts are now left with two choices – and they HATE BOTH: [1] Support Same-Sex Marriage or [2] Support the Estate Tax

    Gallup is really getting pummelled for their polling technique. 
    But maybe a quicker way to understand how they come to such head-scratching results is to simply looking at their crosstabs showing their results by region:
    East: O+4
    Midwest: O+4
    South: R+22
    West: O+6
     
    I don't think that's going to translate into nearly enough Electoral Votes for Mittnocchio … even IF the 7% is accurate
